1. Introduction
Welcome to Bogar Consultancy Services Pvt Ltd (BCS). These Terms and Conditions ("Terms") govern your use of our services and website. By accessing or using our services, you agree to comply with and be bound by these Terms. If you do not agree with these Terms, please do not use our services.
2. Services
BCS provides IT solutions including but not limited to SAP ECC, S/4 HANA Cloud/On-Premise Consulting, Cyber Security, Web and Mobile App Development, E-Commerce, Software Testing, Digital Marketing, IT Advisory Services, and Staffing. The scope of our services will be defined in the specific agreement or contract for each project.
3. Service Agreement
The specific details, terms, and scope of services will be outlined in a Service Agreement between BCS and the client. The Service Agreement will take precedence over these Terms in case of any conflicts.
4. Client Responsibilities
Clients agree to:
Provide accurate and complete information necessary for BCS to deliver services.
Ensure timely access to relevant data, systems, and resources.
Make timely payments as specified in the Service Agreement.
5. Fees and Payment
Fees for our services are detailed in the Service Agreement. Payments are due as outlined in the Agreement. Late payments may incur additional charges.
6. Confidentiality
BCS is committed to protecting the confidentiality of client information. We will not disclose any confidential information to third parties without client consent, except as required by law.
7. Intellectual Property
All intellectual property rights in materials and deliverables produced by BCS during the provision of services remain with BCS unless otherwise agreed. Clients are granted a non-exclusive, non-transferable license to use such materials for their intended purpose.
8. Limitation of Liability
BCS’s liability for any claim arising from the provision of services is limited to the amount paid by the client for the specific service in question. BCS is not liable for any indirect, incidental, or consequential damages.
9. Termination
Either party may terminate the Service Agreement by providing written notice. In the event of termination, the client is responsible for payment for services rendered up to the termination date.
10. Changes to Terms
BCS reserves the right to modify these Terms at any time. Any changes will be effective immediately upon posting on our website. Continued use of our services constitutes acceptance of the revised Terms.
11. Governing Law
These Terms are governed by and construed in accordance with the laws of Tamil Nadu, India. Any disputes arising under these Terms will be subject to the exclusive jurisdiction of the courts in Coimbatore, Tamil Nadu.
